VibesX Terms of Service

Notice: This document is an informational translation provided for convenience. The original, legally binding, and prevailing version is the Spanish version. In the event of any conflict, discrepancy, or inconsistency between this translation and the Spanish version, the Spanish version shall prevail to the extent permitted by applicable law.

These Terms of Service ("Terms") govern access to and use of the VibesX application ("the App", "the Service"), available on Android, iOS, and as a web application at vibesx.app. By creating an account, logging in, or using VibesX as a guest user, you accept these Terms and our Privacy Policy.

1. Description of the Service

VibesX is a location-based social discovery network that allows users to:

Create and explore nearby Vibes (social events and plans) and Flares (short-lived alerts or signals) on a map.
Join plans, invite other users, and chat with participants in each Vibe.
Add friends, create squads, and share content publicly, with friends, or with specific invitees.
Post photos and videos associated with created plans.
Identify yourself to other users via a unique User ID and QR code.
Accumulate internal reward units ("Embers") through App use.

VibesX may modify, add, or discontinue features at any time to improve the Service.

2. User Accounts

2.1 Third-Party Registration

Login to VibesX is conducted exclusively through third-party identity providers (Google, Apple, or Facebook). VibesX does not store or manage passwords directly: authentication and security depend on the selected provider and its own terms of service and privacy policy. You are responsible for maintaining the security of your accounts with those providers.

2.2 Guest Mode

You may use certain features of VibesX as a guest user, without creating an identified account. Guest mode is subject to more restrictive usage limits than a registered account, as outlined in Section 4.

2.3 Accuracy of Information

You agree to provide accurate information on your profile and not to impersonate any other person or user.

2.4 Minimum Age

You must be of the minimum age required by the laws of your country of residence to agree to these Terms without parental consent. In Spain, this age is 14 years (Article 7 LOPDGDD); in other EU Member States it may be higher (up to 16 years, pursuant to the GDPR).

This requirement applies regardless of the absence of adult content in VibesX: the App involves real-time location sharing, open chat with other users, and in-person meetups, posing inherent risks for minors. If you do not meet the minimum age, you must not use VibesX.

3. User Content

3.1 Your Content

You are solely responsible for the Vibes, Flares, photos, videos, chat messages, and other content you post ("User Content"). By posting User Content, you represent that you hold all necessary rights to it and grant VibesX a non-exclusive, worldwide, royalty-free license to host, display, and distribute it within the App solely to provide the Service, according to the visibility settings (public, friends, or invitees) you have chosen.

3.2 Prohibited Content

You may not post content that:

Is unlawful, defamatory, threatening, violent, discriminatory, or harassing.
Infringes intellectual property, publicity, or privacy rights of third parties.
Contains false information regarding the existence, location, or nature of an event intended to deceive other users.
Includes spam, unauthorized advertising, or malicious links.
Endangers the physical safety of other users (such as gatherings organized for unlawful purposes).

VibesX may review, hide, or remove User Content that violates these Terms, and suspend or terminate accounts of repeat offenders.

3.3 Real-World Events and Gatherings

Vibes and Flares created by users describe real-world activities and meetups organized by users themselves, not by VibesX. VibesX is solely a discovery and coordination platform: it does not organize, supervise, or guarantee the safety, legality, or outcome of such gatherings. You must use your own judgment and take reasonable precautions when attending a plan discovered on the App, especially when meeting individuals you do not know.

4. Account Tiers and Usage Limits

VibesX applies usage limits that differ according to account type (guest vs. registered user), including:

Maximum number of Vibes/Flares created per day.
Discovery radius and time window for nearby plans.
Permission to post videos, as well as maximum video duration and file size.
Access to features such as the profile QR code and the rewards wallet.

These limits may be updated at any time to preserve the integrity and performance of the Service.

5. In-App Rewards ("Embers")

VibesX may award internal units ("Embers") for specific actions within the App. These rewards:

Have no monetary value and are not convertible to real money.
May only be used inside the App according to current rules.
May be adjusted, limited, or retired by VibesX without entitlement to compensation.

Currently, VibesX does not process real-money payments or purchases. If paid features or subscriptions are introduced in the future, these Terms will be updated and users will be notified before such changes take effect.

6. Device Permissions

To operate properly, VibesX may request permissions for location, camera, microphone, storage, and notifications. You can grant or revoke these permissions in your device settings; revoking permissions may disable certain App features. For more information, see our Privacy Policy.

7. User Conduct

By using VibesX, you agree not to:

Violate these Terms, applicable law, or the rights of third parties.
Access accounts of other users or attempt to bypass security measures or usage limits.
Use automated tools (bots, scrapers) to extract data from the App without authorization.
Reverse engineer the App except to the extent permitted by law.

8. Intellectual Property

The name "VibesX", its logo, design, source code, and other assets (excluding User Content) are the property of VibesX or its licensors and are protected under intellectual property laws. No license is granted with respect to these assets other than the personal, non-exclusive right to use the App pursuant to these Terms.

9. Account Suspension and Deletion

You may stop using VibesX and delete your account and data at any time directly within the App (Settings → Delete account and data), or by emailing support@vibesx.app. The procedure and data affected are detailed in the Delete Your Account section of our Privacy Policy. VibesX may suspend or terminate your access, in whole or in part, for violation of these Terms, fraudulent use, or legal requirement.

10. Service Availability

VibesX is provided on an "as is" and "as available" basis. We do not guarantee that the Service will operate uninterrupted or error-free. We may update, temporarily suspend, or discontinue App features with reasonable notice where feasible.

11. Limitation of Liability

To the maximum extent permitted by law, VibesX shall not be liable for indirect, incidental, or consequential damages resulting from use of the App, the actions, content, or conduct of other users, or events taking place during meetups organized through the Service. Nothing in these Terms limits liabilities that cannot be excluded under applicable consumer protection legislation.

12. Third-Party Links and Services

The App may contain links to third-party services (such as Google Maps or Google Calendar) for convenience. VibesX does not control and assumes no liability for the content or practices of such third-party services.

13. Modifications to These Terms

We may update these Terms to reflect changes in the Service or applicable law. We will post the current version on this page along with the date of last revision. Continued use of VibesX after modifications constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute arising from the use of VibesX, the parties submit to the competent courts of Spain under applicable law, without prejudice to any statutory rights that consumers residing in another EU Member State may have under mandatory consumer protection laws.
